  • CLIENT SUCCESS COMPETITION TERMS AND CONDITIONS

    1. The promoter is Jenny Craig Weight Loss Centres Pty Ltd ABN 61 006 109 842 trading as “Jenny Craig” of Level 1, 464 St Kilda Road, Melbourne in the State of Victoria 3004 Australia (Promoter).
    2. Information about how to enter the competition, and the prizes available, form part of these Terms and Conditions, and are also located in Jenny Craig centres and are available online at www.jennycraig.com.au/terms. Participation in this competition is deemed to be acceptance of these Terms and Conditions.
    3. This competition commences 12 October 2016 (Commencement Date) and finishes at 12.00pm AEST on 23 October 2016 (Close Date).
    4. Entry and participation is only open to current and former Jenny Craig adult (18 years and over) members who are residents of Australia or New Zealand, and subject to the conditions available at www.jennycraig.com.au/terms, who hold or have held a valid membership at a participating Jenny Craig centre in Australia or New Zealand.
    5. The competition is a game of skill, whereby each entrant must, between the Commencement Date and the Close Date (Competition Period), submit an entry form via Jenny Craig’s approved competition page, http://www.jennycraig.com.au/JCsuccessstorysearch, including the entrant’s name, age, sex, weight loss amount, goal weight, email address, phone number, details of the Jenny Craig centre attended, before and after pictures, and a description in 25 words or less about why or how Jenny Craig changed the entrant’s life (Entry Form).
    6. The finalists and the winners of the competition will be judged by representatives of Jenny Craig, in their absolute discretion, and will be based on the Entry Criteria outlined below. The Entry Criteria requires the entrant to:
      1. be (or have been) a Jenny Craig member;
      2. be at their goal weight (or within 2kg of their goal weight);
      3. demonstrate that the weight was lost while the entrant was on the Jenny Craig program;
      4. show significant and substantial dedication to the Jenny Craig Program;
      5. have the most inspirational, unique or interesting weight loss story;
      6. submit their entry via the online Entry Form during the Competition Period;

    (Entry Criteria).

    1. Employees of the Promoter (and their immediate family members) and agencies associated with this competition are ineligible to win a prize. For completion, immediate family member includes a spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
    2. As a condition of entry, entrants acknowledge that a profile of each eligible entrant (based on the information contained in their Entry Form) may be published at any time by Jenny Craig as deemed appropriate.
    3. The Promoter reserves the right, at any time, to verify the validity of entries, (including their identity and age) and to disqualify any entrants whose entry is not submitted in accordance with these Terms and Conditions or who otherwise tamper with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
    4. Incomplete or indecipherable entries will be deemed invalid.
    5. This is a game of skill and chance plays no part in determining the winners. At the conclusion of the Competition Period, a panel of judges will individually judge each entry, based on the merit of the answers provided to the questions posed on the Entry Form, the Entry Criteria, and the answers relating to the eligible entrant’s success with Jenny Craig.
    6. Out of the eligible entrants, three (3) finalists will be selected by Jenny Craig based on the Entry Criteria who will each win a $50 Jenny Craig voucher to spend on Jenny Craig food and will also feature on the Jenny Craig blog between the period from 1 November 2016 to 30 June 2017. From the three (3) finalists one (1) winner will be chosen by Jenny Craig based on the Entry Criteria who will win a $1,000.00 VISA gift card, will be featured on the Jenny Craig blog between the period from 1 November 2016 to 30 June 2017 and will have the change to be part of Jenny Craig’s summer television commercial (TVC). The Promoter is not under any obligation to feature the winner in the summer TVC nor award additional prizes.
    7. The three (3) finalists acknowledge that all material gathered and produced as a result of the entry will be owned by the Promoter and the finalists and the winner consent to the use of their image in the same. The finalists and the winner agrees to sign any legal documentation, and provide any additional information required, in the form determined by the Promoter in their absolute discretion, to give effect to this consent and appropriately advertise the entry.
    8. The three (3) finalists will be informed by 5:00pm AEST on 7 November 2016 and the one (1) winner will be informed by 5:00pm AEST on 14 November 2016 to confirm their prizes.
    9. Prizes are not redeemable for cash and are not transferrable. All vouchers and prizes are to be awarded by a provider selected by the Promoter in its absolute discretion. Prizes are subject to the terms and conditions of each individual service provider.
    10. The Promoter's decision is final in all aspects of this competition and no correspondence will be entered into.
    11. As a condition of entry, the entrant agrees that they are fully responsible for any content that they submit. The Promoter shall not be liable in any way for such content to the full extent permitted by law. The entrant warrants and agrees that:
      1. with regard to any materials submitted via the competition including answers to competition questions, comments, recordings and images (Content), unless the Promoter advises otherwise, the entrant grants the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display such Content for any purpose in any media, without compensation, restriction on use, attribution or liability. The entrant agrees not to assert any moral rights in relation to such use. The entrant warrants that they have the full authority to grant these rights.
      2. they will not submit any content that is unlawful or fraudulent, or that the Promoter, or any advisor of the Promoter, may deem to be or that could be in breach of any privacy, publicity or other rights;
      3. they will obtain prior consent from any person or company that appears in any submitted content;
      4. they will comply with all applicable laws and regulations, including without limitation, those governing privacy, publicity and the access or use of any other persons' computer, technology or communication systems.
    12. Without limiting any other terms herein, the entrant will indemnify the Promoter for any breach of these Terms and Conditions.
    13. The entrant consents to the Promoter using their name, likeness, image and/or voice in the event they submit a winning entry (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of publicising the competition (including any outcome), and marketing or publicising any products manufactured, distributed and/or supplied by the Promoter.
    14. If the competition is interfered with or frustrated in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law:
      1. to disqualify the entrant; and/or
      2. to modify, suspend, terminate or cancel the competition.
    15. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth) or the Consumer Guarantees Act 1993 (NZ), as appropriate (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter, their related entities, associates, affiliates and each’s  respective officers, employees and agents (each a Relevant Person) excludes (and exclude) all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising out of or in connection with, the Promotion or these Terms and Conditions.
    16. Except for any liability that cannot be excluded by law, including the Non-Excludable Guarantees, no Relevant Person is responsible for, and each Relevant Persons excludes all liability (including negligence), for, any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising out of, or in connection with, any of the following:
      1. any technical difficulties or equipment malfunction (whether or not under the Promoter's control);
      2. any theft, unauthorised access or third party interference, whether with an entrant’s, finalists or winners Entry Form or otherwise;
      3. any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
      4. any variation in the prize value to that stated in these Terms and Conditions (if applicable);
      5. any tax liability incurred by a finalist or a winner; and/or
      6. taking of or use of any prize by a finalist and/or the winning entrant (and the winning entrant’s companion).
    17. The Promoter collects personal information in order to conduct the competition and may, for this purpose, disclose such personal information to third parties, including but not limited to agents, contractors and service providers and use the personal information for the purposes described in these Terms and Conditions and the Promoter’s Privacy Policy. Entry by an eligible Jenny Craig member is conditional on the eligible Jenny Craig member providing this information to the Promoter. The Promoter’s Privacy Policy is available at www.jennycraig.com.au/privacy. In addition to the purposes stated in the Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the personal information for promotional, marketing, publicity, research and profiling purposes, subject to applicable privacy law and regulation. All entries become the property of the Promoter.

    The laws of the State of Victoria Australia or the laws of New Zealand (depending on where the entrant is located) apply to the Promotion and these Terms and Conditions to the exclusion of any other law. Eligible entrants submit to the exclusive jurisdiction of the courts of the State of Victoria Australia or New Zealand, as appropriate.

  • Jenny My Way Offer Terms and Conditions

    Business Day means a day upon which banks are open for business in the State of Victoria, Australia (if you reside in Australia) or Auckland, New Zealand (if you reside in New Zealand).

    Centre is the Jenny Craig Centre in which you enrolled for the Program.

    Commitment Period means the period that commences on the date that your Program starts and ends twelve (12) weeks after that date, or, such other date that Jenny Craig agrees in writing from time to time, including, by posting that date at http://www.jennycraig.com.au/how-it-works (if you reside in Australia) or http://www.jennycraig.co.nz/how-it-works (if you reside in New Zealand).

    Commitment Period Suspension Notice and Commitment Period Extension Notice are the written notices by which you may exercise your right to suspend the Commitment Period, or, extend the Commitment Period (as the context requires). A copy of the Commitment Period Suspension Notice and Commitment Period Extension Notice are available at the Centre and each (as the context requires) may be served on Jenny Craig by delivering it in person or having it delivered to the Centre by registered mail, or, faxing or emailing it to the Centre.

    Jenny Craig, our or us is Jenny Craig Weight Loss Centres Pty Ltd (ABN 61 006 109 842) if you reside in Australia, or, Jenny Craig Weight Loss Centres (NZ) Limited (Company Number 271677) if you reside in New Zealand.

    Program is the Jenny Craig Program that you have elected to participate in from time to time under your Membership Agreement with us.

    1. You (Client) must have a current Membership Agreement with us and have paid for the membership and other rights and entitlements afforded to you under that Membership Agreement in order to be eligible for the Jenny My Way Offer.
    2. Jenny Craig agrees to provide the Discount less any Transaction Fee (each as respectively referred to at http://www.jennycraig.com.au/how-it-works (if you reside in Australia) or http://www.jennycraig.co.nz/how-it-works (if you reside in New Zealand) from time to time) to you in consideration of you agreeing to the Commitment Period and purchasing our full week meal plan or the 5+2 half-way meal plan during the Commitment Period and otherwise complying with the terms and conditions of the Membership Agreement and these Jenny My Way Offer Terms and Conditions.
    3. You may extend the Commitment Period for further Commitment Periods (each a Further Commitment Period) by providing us with the Commitment Period Extension Notice at any time up to and including the day that is twenty (20) Business Days following the end of the Commitment Period or Further Commitment Period (as the context requires).
    4. You are entitled to suspend the Commitment Period once for a period of up to ten (10) Business Days by providing us with the Commitment Period Suspension Notice and such Commitment Period Suspension Notice being accepted by us (acting reasonably).
    5. You agree that in the event that your Membership Agreement is terminated, or, if you cease the Program, at any time, during the Commitment Period (or any Further Commitment Period, as the context requires), other than as permitted by this Jenny My Way Offer, the Discount that has been received by you will be refundable to Jenny Craig in accordance with the Discount Sliding Scale (as referred to at http://www.jennycraig.com.au/terms (if you reside in Australia) or http://www.jennycraig.co.nz/terms (if you reside in New Zealand) from time to time). Consequently, you further agree that we may retain your credit card details for the purpose of debiting your credit card the Discount Sliding Scale if a refund is payable to Jenny Craig.
    6. The Jenny My Way Offer is not available in conjunction with any other offer.
    7. Jenny Craig may vary, update or terminate this Jenny My Way Offer at any time by varying, updating or removing it from http://www.jennycraig.com.au/terms (if you reside in Australia) or http://www.jennycraig.co.nz/terms (if you reside in New Zealand) Variations and updates will be effective for new customers from the date of the variations and updates. Termination of this Jenny My Way Offer will not affect customers (you) that have accepted the Jenny My Way Offer prior to the date of termination.

    • In order for you and the New Client to be eligible to each receive the Discount:
      • you must provide contact details for the New Client to Jenny Craig before 30 June 2017;
      • you must have a current and valid Membership Agreement and Program with Jenny Craig;

  • Home Delivery

    • Home delivery will only occur for addresses within the postcode areas nominated by us from time to time.
    • During the ordering process, you will be required to select a date and delivery window for your order to be delivered. You will provide us with complete and accurate information to complete your order.
    • All efforts will be made to deliver your order on the date and delivery window selected, however due to events beyond our reasonable control; we may not be able to do so and will not be liable to you or any other person for any such delay.
    • If your address is within the postcode nominated by us, we will deliver the order to the front door of your nominated delivery address. If you request your order to delivered inside a premises or a building, and we agree to do so, then you are responsible for any loss or damage suffered in connection with our delivery of your order beyond the front door. You must make all necessary arrangements to allow your order to be delivered, including obtaining any prior security or approvals which may apply to your delivery location.
    • If your address is outside of the postcode areas nominated by us, then your order will be delivered to a central business location or central pick-up location, nominated by us. You will then be required to collect your order from this central business location or central pick-up location.
    • You may be required to provide us with appropriate proof of identity. If the order has been paid by credit card, you may also be asked to show the credit card in order for verification checks to be conducted.
    • Jenny Craig accepts no liability or responsibility for incorrectly placed orders. Nor do we accept liability or responsibility for delivery details which are incorrectly supplied, or you fail to supply.
    • If you will not be at the delivery address at the expected delivery time, we recommend you nominate a cool safe place for delivery of your order. If you do not provide a specific place for delivery, your order will be left at your front door. If you advise of any specific delivery instructions in your order, all reasonable endeavours will be made to comply with these instructions to the extent reasonably within Jenny Craig’s control.
